The Horse Racing Integrity and Safety Act (HISA) Authority has taken a bold step, summoning Churchill Downs Racetrack and its parent company, CDI, to a hearing over alleged non-payment of assessment fees. This move threatens to bar Churchill from participating in races if the fees remain unpaid.
Here's the crux: HISA claims CDI owes $2,408,501 in overdue 2025 fees, plus interest, for four racetracks it owns. If CDI doesn't pay up within 10 days of the upcoming March 11 hearing, Churchill could be prohibited from racing.
But here's where it gets controversial: CDI disputes the methodology used to calculate these fees and has refused to pay, arguing that HISA's assessment formula is illegal. This disagreement has led to a federal lawsuit, currently ongoing.
CDI's original complaint, filed in 2024, argued that HISA lacks the authority to adjudicate fee disputes internally and should instead bring civil actions in federal court. The lawsuit further alleges that HISA's actions violate the Constitution and due process principles.
Despite these legal battles, HISA maintains that CDI is 'freeloading' on its services, including drug testing, results management, and track inspections, without contributing financially.
The upcoming hearing will be chaired by Joe De Francis, with Bill Thomason and Terri Mazur also adjudicating. CDI has until February 27 to file any objections, and HISA's counsel has until March 6 to respond.
